1. Acceptance of Terms

By accessing or using the services provided by Eyebroadband ("we", "us", or "our") through our website eyebroadband.com or any related platforms, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our services.

2. Services Description

Eyebroadband provides the following services:

• Internet & Broadband: high-speed fibre and wireless broadband connectivity for residential and commercial customers.
• Shopify Development: custom Shopify theme development, app development, store setup, and ongoing maintenance.
• AI Solutions: AI-powered chatbots, automation workflows, and intelligent integrations using platforms like ChatGPT, Gemini, and Claude.
• Custom Software Development: bespoke web applications, SaaS products, and enterprise software solutions.

3. User Accounts

Certain services require you to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised access or use of your account.

4. Payment Terms

• All fees are quoted in Indian Rupees (INR) unless otherwise stated.
• Payment is due as per the schedule outlined in your service agreement or invoice.
• Late payments may attract interest at 1.5% per month on the outstanding balance.
• We reserve the right to suspend services for non-payment after a 15-day grace period.

5. Internet Service Terms

Speeds:Advertised speeds are "up to" figures and represent the maximum achievable speed. Actual speeds may vary based on network congestion, hardware, and environmental factors.

Uptime SLA: We target 99.9% network uptime measured on a monthly basis. Scheduled maintenance windows are excluded from SLA calculations. Service credits may be issued for verified downtime exceeding the SLA threshold.

Fair Usage Policy: All broadband plans are subject to a fair usage policy. Excessive usage that negatively impacts other subscribers may result in temporary speed throttling or a request to upgrade your plan.

6. Software Development Terms

Project Scope: All software development projects are governed by a separate Statement of Work (SOW) or project proposal that defines deliverables, timelines, and milestones. Changes to scope require written agreement and may affect pricing and timelines.

Intellectual Property Ownership: Upon full payment, all custom code and deliverables created specifically for your project are transferred to you. Pre-existing libraries, frameworks, and proprietary tools used by Eyebroadband remain our intellectual property.

Warranties: We provide a 30-day warranty period after project delivery during which we will fix bugs at no additional cost. This warranty covers defects in functionality as defined in the SOW and does not cover issues arising from third-party services, client modifications, or changes in scope.

7. Intellectual Property

All content on eyebroadband.com, including text, graphics, logos, icons, images, and software, is the property of Eyebroadband or its content suppliers and is protected by Indian and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by law, Eyebroadband shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to the use of our services. Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim in the twelve (12) months preceding the event.

9. Termination

Either party may terminate services by providing 30 days' written notice. We reserve the right to suspend or terminate your access immediately if you breach these terms, engage in illegal activity, or fail to make payment after the grace period. Upon termination, any outstanding fees become immediately due.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.
